1. Introduction

These Terms of Service ("Terms") govern your access to and use of the BigTinyBook service ("Service") provided by Alokita ("we," "us," or "our").

Alokita is an Indonesian company, with headquarters located in Palembang, Indonesia.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Using Our Service

2.1 Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this requirement.

3.1 Content Ownership

You retain all ownership rights to the content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute such User Content in connection with providing and improving the Service.

3.2 Content Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that: (1) you are the creator and owner of the User Content or have the necessary licenses, rights, consents, and permissions to authorize us to use your User Content as described herein; and (2) your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other personal or proprietary rights.

4.1 Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Alokita and its licensors. The Service is protected by copyright, trademark, and other laws of both Indonesia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Alokita.

4.2 Feedback

If you provide us with any feedback or suggestions regarding the Service ("Feedback"), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use and act on such Feedback in any manner we deem appropriate.

5. Subscription and Payment

5.1 Subscription Terms

We offer various subscription plans for our Service. By selecting a subscription plan, you agree to pay the subscription fees indicated for that plan. Subscription fees are payable in advance and may be recurring.

5.2 Payment

We use third-party payment processors to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of our payment processors in addition to these Terms.

5.3 Free Trial

We may, at our sole discretion, offer a free trial subscription for a limited period. You may be required to enter your payment information to sign up for the free trial. If you do not cancel your subscription before the end of the free trial, you will be automatically charged the applicable subscription fees.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting us. If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period. We do not provide refunds for the unused portion of your subscription.

6. Termination

6.1 Termination by You

You may terminate these Terms at any time by canceling your account and discontinuing use of the Service.

6.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

6.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. If your account is terminated due to your breach of these Terms, you may not register a new account without our permission.

7.1 Service Availability

We strive to provide a reliable Service, but we do not guarantee that the Service will be available at all times. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

7.2 Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8. Limitation of Liability

IN NO EVENT SHALL ALOKITA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Alokita and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall first be attempted to be resolved through good faith negotiations between the parties. If such dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Palembang, Indonesia.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alokita regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
